Societatea Diaconu Agriplant S.R.L., hereinafter referred to as “MADE BY SOCIETY” or simply “the Company”, headquartered in Romania, Botoșani County, Răchiți, Industrial Zone, 1st floor, office no. 1, with unique registration code 37295920, fiscal attribute RO, established and operating in accordance with Romanian regulations, owner of the MADE BY SOCIETY stores, as the Merchant - Seller, grants consumers this warranty certificate associated with products purchased from our stores.
All products sold by ”MADE BY SOCIETY” come with a warranty, which starts on the day the product is purchased, or as applicable, is delivered to the Client. The following definitions are relevant and applicable regarding the products sold on the website madebysociety.ro or in the ”MADE BY SOCIETY” stores:
Commercial warranty (also called “durability warranty”) – any commitment from the Company to the client, provided in this Warranty Certificate or in the advertising available at the time or before the conclusion of the contract, in addition to the legal obligations which the Company has regarding the conformity warranty, to replace the defective product with a new one or, if applicable, to refund the Buyer the price paid for the non-conforming product in exchange for it when the first measure is not possible for the Seller and only if the product does not meet specifications or any other requirements that are not related to conformity, respectively only when these are attributable to the Seller and/or Manufacturer; In the case of replacing the non-conforming product with a new one, the commercial warranty also applies to this latter.
Commercial warranty period – the time limit, starting from the date of product acquisition, until which the Manufacturer or Seller assumes responsibility for replacing the non-conforming product or, if applicable, refunding the corresponding amount (in exchange for the non-conforming product) if the first measure is not possible, at their expense, and only if the deficiencies are not attributable to the consumer, respectively if these are attributable to the Seller and/or Manufacturer; The warranty period (commercial warranty) is 30 (thirty) calendar days and begins with the moment the Consumer has acquired the product from the Seller.
Non-conformity covered by the commercial warranty – a deviation of a product characteristic in relation to the legally existing subjective and objective conformity requirements, which occurs within the warranty period and only if it is attributable to the Manufacturer and/or Seller;
General specifications:
The right to warranty can only be exercised if the item in question is accompanied by the fiscal invoice or, as applicable, the fiscal receipt regarding the product purchase related to the claim, in accordance with O.U.G 140/2021 and O.G. no. 21/1992, normative acts issued in Romania, the country where the sale-purchase legal relationship occurs, representing the place where the price is collected and the purchased item is handed over by the Seller to the Consumer or, as applicable, to third-party shippers in the case of distance sales.
For the products sold, MADE BY SOCIETY offers a commercial warranty for any non-conformity existing at the time of sale of the goods and detected within 30 (thirty) calendar days from the date they were acquired by the Consumer through purchase from the Seller's store. The commercial warranty (for durability) also applies when the product's non-conformities appear within the above-mentioned 30 (thirty) calendar days.
The recommended procedure for accessing the warranty is applied as follows:
- Delivery to the Seller of the product regarding which deficiencies are reported, along with the related receipt/invoice proving the purchase (copy) and a justified claim from the Consumer, (such as the form for exercising the right to warranty provided as a model) are essential elements for our company to resolve any subsequent complaint. The product (complete and clean) regarding which deficiencies are reported must be delivered to the store from which it was purchased for inspection by the Seller. In the case of online purchases, the product must be delivered/shipped by the Consumer, with declared content, receipt confirmation, and the possibility of being inspected upon delivery to the Seller at our secondary headquarters in Romania, Ilfov County, Căldăraru, Oxigenului Street no. 1D, Online Dept. – MADE BY SOCIETY, and for purchases from physical stores, the product must be delivered to the point of sale from which it was purchased by the Consumer.
- Measures subject to the warranty (product replacement or, if applicable, refund of the corresponding amount in exchange for handing over the non-conforming product to the Seller) will be granted under the condition that the existing deficiencies are attributable to the Seller or Manufacturer, and the consumer has adhered to the usage conditions and recommendations, including those stipulated in the law and the warranty certificate. In the case of a justified claim proven upon inspection, formulated in writing within the terms and conditions stipulated in the law and this warranty certificate, our Company, at no cost, will replace the respective product with a similar one (new and of the same size) if the latter is available in stock. Only if such a product is not available in stock will the Consumer be refunded the value of the product in question, as recorded in the receipt or fiscal invoice related to the sale-purchase. However, the Consumer has the right to request the Seller to replace the non-conforming product with another type and/or size product with a value at least equal to the non-conforming product, and the Seller has the right, within their capabilities and at their discretion, to accept such a request from the Client, following which the latter may, if applicable, pay the Seller the positive value difference between the replaced product and the replacement product. Replacement or, if applicable, refund of the corresponding amount for the item in question (the latter measure being carried out by resolving the sale-purchase contract) will be performed by our Company within 15 calendar days from the moment we receive the item in question for inspection, accompanied by the related invoice or receipt and a justified claim formulated within the terms and conditions stipulated in the law and this warranty certificate, and only if we find non-conformities of the product attributable to the Seller or Manufacturer.
- If the deficiencies reported by the Consumer are not attributable to the Manufacturer or Seller, or if the inspection could not be carried out due to non-compliance with the legal provisions or those stipulated in the warranty certificate by the Consumer (for example, the Consumer handed over the product to the Seller incomplete or dirty although it was not purchased that way), the latter will bear any costs incurred by our company regarding the claim in question (e.g., costs for inspection, delivery costs, etc.).
- If, after inspection, deficiencies are found that involve product replacement, the new product will be delivered to the consumer at the delivery address indicated by them (in the case of online purchases) or in the store where the product with the deficiencies was delivered by the Consumer. In such a case, the warranty is extended by the period between the moment the item with deficiencies was delivered to the Seller and the moment the new product is delivered to the Consumer. The costs associated with such a case will be borne by the merchant.
- If, after inspection, deficiencies are found that involve refunding the corresponding amount for the product, the amount in question will be paid into the consumer's bank account (in the case of online purchases) or in the store where the product with deficiencies was delivered to the Consumer. The costs associated with such a case will be borne by the merchant.
- If, after inspection, no deficiencies attributable to
the Seller or Manufacturer are found, the inspected product will be returned to the Consumer either to the address indicated by them or to the store where it was delivered to the merchant. The costs associated with such a case will be borne by the Consumer.
In certain cases expressly provided by law and respectively in this Warranty Certificate, the client may request withdrawal from the contract and return of the purchased product(s), or as applicable, ordered and delivered in any of the following cases:
- the seller did not complete the replacement or, as applicable, refused to bring the product into conformity under the conditions of Art. 11 of OUG 140/2021;
- the non-conformity is of such a severity that it justifies the right to immediate termination of the product sale contract;
IMPORTANT: This warranty certificate is supplemented by law with the imperative provisions stipulated in the applicable normative acts regarding the product warranty regime, including those imperatively stipulated in Emergency Ordinance no. 140/2021 regarding certain aspects related to sales contracts for goods and in Government Ordinance no. 21/1992 on consumer protection.
Instructions for Use and Maintenance of Products Sold by "MADE BY SOCIETY"
The warranty is effective for products purchased from our company and used by the Consumer under normal and proper conditions, according to the instructions for use. The instructions for use are presented on the labels and/or, as applicable, in the documents related to the products sold. It is absolutely necessary to consult the label of each purchased product to ensure proper use, thereby avoiding loss of warranty through improper handling. We reserve the right, in addition to the instructions presented on the product labels, to present consumers with other additional written instructions, in which case these must also be complied with.
Regarding clothing items (including fashion accessories), these must be washed or cleaned according to the instructions on the product label and, if applicable, those additionally presented by our company. Do not use industrial cleaning products or other inappropriate or unsuitable products, such as but not limited to those containing soda or other chemical derivatives. Ensure in advance that the products you use for washing and cleaning are safe and meet the quality requirements imposed by the legislation applicable in the place of sale. Please also follow the recommendations/pictograms regarding washing and cleaning temperatures, as well as the indicated methods for performing these actions. Furthermore, we inform you that the bags and backpacks sold by our company are only fashion accessories, meaning they are not designed to support the storage or transport of weights greater than 1 kilogram. We note that the textile face masks sold through our store are exclusively fashion accessories.
Regarding leather clothing items and belts, these can be cleaned with a soft, damp cloth, without using detergents, solvents, bleaches, or any other chemical substances. These solutions can cause irreversible damage to the appearance of the leather, and such a situation is not covered by the warranty. If the item gets wet, wipe it with a soft cloth and let it dry at room temperature, without direct contact with heat sources. Do not wash leather clothing or belts in the washing machine, except in situations where otherwise specified on the product labels.
Regarding footwear, it is recommended to wear 2-3 pairs of shoes alternately. Such products with leather surfaces must be regularly cleaned of dust with a cloth or a soft brush. Polish the shoes periodically with a soft cloth. Do not wash the shoes in the washing machine. Prolonged contact with water can lead to shoe deterioration and invalidate the warranty. The shoes should be dried slowly, not with the help of heat sources. Please use a shoehorn to avoid damage to the heel area of these products. Some footwear items may be dyed, and as a result, some colors may migrate. This phenomenon is not a defect.
Regarding all products sold by "MADE BY SOCIETY" do not dry the products by placing them directly on heat sources such as but not limited to radiators, heaters, or stoves. Keep the products away from objects that could cause snags, burns, discoloration, stains, perforations, tears, pilling, scratches, or any other physical actions that may cause damage, including protecting them from domestic animals, insects, rodents, etc. Do not use or store products near harmful substances such as sprays, acetone, acid, oils, benzene, insecticide, or other damaging substances, and ensure their storage in suitable places, protected from excessive humidity, direct heat sources, and prolonged direct sunlight. Clothing/footwear items should have their fastening mechanisms open during dressing/undressing and putting on/taking off to avoid mechanical damage to the product and the respective mechanisms. Please note that the products sold by our company are not intended for sports use and do not have the technical properties of sportswear. Additionally, the products should be kept away from actions and contact with other objects that can cause snags or tears. Our company does not assume responsibility for damages caused intentionally or negligently, by violating the product's usage instructions. Furthermore, our responsibility is not engaged for damages caused by third parties, such as professional cleaning or repair service providers.
